Background on the Truck Cartel

With two decisions in July 2016 and September 2017, the European Commission imposed record fines totaling around 3.8 billion euros on the major European truck manufacturers Daimler, MAN, Volvo, Renault, DAF, Iveco, and Scania. The most fundamental and latest information is from February when the European Court of Justice rejected the appeal of Scania, which consequently failed in its fight against the European Commission’s decision from 2017, which stated that Scania was also a member of the cartel, just like the other major brands already mentioned.

Between 1997 and 2011 (but with lingering effect till 2016), the manufacturers made agreements in violation of antitrust law on prices and gross price increases for the heavy and medium-duty trucks they manufactured and sold in the European economic area.
In addition, the cartel members made agreements on the schedule and the transfer of costs for the emission protection standards Euro 3 to 6. 

MAN had uncovered the cartel as a key witness. The truck manufacturers have admitted the allegations and accepted the fines in a settlement procedure with the European Commission. Scania is the only manufacturer still suing the European courts against the fine.

Current status of our proceedings in Germany and the Netherlands

Legal Proceedings Update

Since 2020, we have been actively pursuing claims against the truck cartel. To date, we have filed several waves of claims in the Netherlands and Germany, representing over 1.600 companies with more than 40.000 trucks. The courts in Netherlands have instructed the opposing party to respond to these claims and review all relevant documents submitted by LitFin. The deadline for response is set in 2 batches to July 2026 and January 2027. In Germany we are awaiting an economic opinion on the calculation of damages on all relevant markets from the court appointed economic experts.

On March 21, 2025, the Dutch Supreme Court referred several key legal questions to the Court of Justice of the European Union (CJEU) regarding the applicable law and single continuous infringement. This could result in a temporary suspension of damages proceedings in Amsterdam (and potentially in other jurisdictions) while awaiting the CJEU's guidance. Some estimates suggest delays of up to two additional years.
